Agreement
By ordering any product from Herbaldom.com, I, as purchaser and/or end user, agree to provide true and correct information as required and to read and understand all statements and portions of this contract (The Terms & Conditions) and agree to abide by all of the terms and conditions as stated and to consider them binding under any and all circumstances and any dispute will be handled in the EU.
Policy Statement
All products sold by Herbaldom.com should be handled only by competent, suitably trained or knowledgeable persons, familiar with proper industry specific procedures. The burden of safe use and handling of products sold by Herbaldom.com rests with the purchaser and or end user. By purchasing these products, the purchaser acknowledges that there may be hazards associated with their handling and use. The purchaser and/or end user also assumes the responsibility for safe and lawful use and disposal of all products purchased. The purchaser and/or end user assumes all responsibility for warning his employees and any persons who might come into contact with the purchased products, of all risks to person and property in any way connected with the use, storage, and health implications of the products and for instructing them in their safe handling, storage, and use.
The purchaser and/or end user represents and warrants that from his/her own independent review and study (s)he is fully aware and knowledgeable about (a) the health and safety hazards associated with the handling of the products purchased; (b) industrial hygiene controls necessary to protect his/her workers from such health and safety hazards; (c) the need to adequately warn of health and safety hazards associated with products; and (d) government regulations regarding the use of and exposure to such products.
The purchaser and/or end user shall indemnify Herbaldom.com and any of its employees or affiliates for and against any and all losses, damages and expenses, including legal fees and other costs of defending any action, that Herbaldom.com may sustain or incur as a result of any act or omission by the purchaser and or end user, its officers, agents or employees, its successors or assignees, its customers or all other third parties, whether direct, or indirect, in connection with the use of any product. Furthermore the purchaser and/or end user agrees that they are over the age of 18 at the time of purchase, since Herbaldom.com does not allow individuals under the age of 18 to purchase their products, that they are trained and qualified in proper handling procedures for the products being used or purchased and that I as purchaser and/or end user am familiar with potential hazards associated with said products.
End User Agreement with Purchaser
I understand and agree that if I am not the end user that it is my responsibility to make known to the end user any and all information related to the MSDS, safe handling, any and all other relevant information, and potential hazards associated with purchased product(s).
Safe Use
The purchaser and/or end user assumes the responsibility for the safe use or disposal of all products in accordance with all applicable laws.
By purchasing I understand that the absence of a warning must not be interpreted as an indication of safety, as complete information regarding hazards and risks may not be available for my purchased products.
Not for Improper/Illegal Use
I understand and agree that the products sold by Herbaldom.com are not to be used for purposes for which you do not have a license or is legal in your jurisdiction. I further agree that the purchased product will not be used in the diagnosis, treatment or mitigation of any disease or malady, unless I am specifically authorized by my jurisdiction to do so. Herbaldom.com offers no warranty regarding the fitness of any product for a particular purpose and shall not be responsible for any loss or damage whatsoever arising there from.
Shipping Carrier Delays
By purchasing from Herbaldom.com I understand that Herbaldom.com is not responsible for shipping delays by shipping organizations. In the event of a shipping delay, customers are not entitled to a refund for the price they have paid for shipping or their order total. Customers will only be entitled to a refund or replacement of a package, once that package has been declared officially “lost” by the shipping carrier. In addition, customers who choose to have their packages delivered via an “express” or “expedited” shipping method, are not guaranteed a refund for shipping costs even if the package is not delivered on time.
Undeliverable Packages
In the event that a package is marked as undeliverable and returned to us by the shipping organization, we will treat this package as an authorized returned item. We will refund your order minus a $5 restocking fee and shipping charges. Due to delivery issues, we also do not ship packages for General Delivery by USPS. We also reserve the right to deny any future orders from customers who provide to us an address for a package that gets returned to us by the shipping organization.
Returned Goods Statement
Herbaldom.com will make every effort to ensure that your purchase meets or exceeds expectations with regard to quality, packaging, and storage until shipped. If it becomes necessary to return merchandise, please contact us. Returns must be authorized before being sent back, and must be packaged and shipped in compliance with all applicable laws and regulations. Only items authorized by Herbaldom.com for return will be accepted. Final disposition of returned goods will be made only after receipt and inspection of goods. Returns must be received within 14 days of receipt. International shipments are not able to be returned. Materials returned requiring disposal may incur additional charges. Certain returns are not accepted; including but not limited to: opened, leaking or damaged containers; materials with a shelf life; materials which must be refrigerated; custom or special orders; items with missing or obliterated labels.
Upon the approved return of any such product, Herbaldom.com shall have the option to replace such product (if defective) with a conforming product or to refund the purchase price to customer, at Herbaldom.com’s sole discretion. Purchaser’s exclusive remedy, for any cause or claim whatsoever, including but not limited to alleged breach of warranty, product liability, negligence, or otherwise, shall be for money damages in an amount not to exceed the purchase price paid by purchaser for the product in respect to which the claim is made. In no event shall Herbaldom.com be liable for special, incidental or consequential damages, whether purchaser’s claim in contract, negligence, strict liability or otherwise.
Opened products consisting of a dry weight of 1KG or more when sold, cannot be returned open. These products need to be discarded when returned. No returns on sales for prices that have been reduced or items purchased with a discount code for a percentage off, be sure you want a product before you finalize the purchase.
I understand that Herbaldom.com will not accept unidentified or unauthorized return shipments or return shipments made without prior authorization and that Herbaldom.com will discard such shipments without reissue of credit to the purchaser.
Limited Warranties
The information included on this website has been obtained from normally reliable and dependable sources and is correct to the best of our knowledge; however, we cannot guarantee it as such. Herbaldom.com makes no other representations or warranty of any kind, express or implied, as to merchantability, fitness for particular purpose, or any other matter with respect to our products, whether used alone or in connection with any other.
